The rules and responsibilities that apply when you use Martian List.

Agreement to terms

These Terms of Service ("Terms") govern your access to and use of Martian List (the "Service"). By accessing or using the Service, creating an account, or completing registration, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

Eligibility and invite-only access

You must be at least 18 years old and able to form a binding contract to use the Service.

Registration is invite-only. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

Accounts and roles

You agree to provide accurate registration information and keep it up to date.

The Service supports different participant roles, including customers, vendors, influencers, and industry workers. Features available to you depend on your role and verification status.

We may suspend or terminate accounts that violate these Terms, provide false information, or create security or legal risk for the community.

Acceptable use

You agree not to:

  • Use the Service for unlawful, fraudulent, harassing, or abusive activity.
  • Post content that is hateful, sexually exploitative, threatening, or otherwise harmful.
  • Impersonate another person or misrepresent your affiliation, credentials, or business.
  • Scrape, reverse engineer, or attempt to bypass security, rate limits, or access controls.
  • Upload malware, spam, or content that infringes intellectual property or privacy rights.
  • Manipulate reputation systems, invites, deals, or promotions in bad faith.

Your content

You retain ownership of content you submit, but grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content solely to operate, promote, and improve the Service.

You represent that you have the rights needed to share your content and that it does not violate these Terms or applicable law.

We may remove or restrict content that violates these Terms or community standards, with or without notice.

Vendor offers, deals, and promotions

Vendors and partners are responsible for the accuracy of offers, availability, pricing, redemption rules, and compliance with applicable laws.

Martian List may facilitate discovery and redemption workflows but does not guarantee third-party offers unless expressly stated.

Privacy

Our Privacy Policy explains how we collect and use personal information. By using the Service, you consent to those practices.

Private direct messages between users are confidential to the participants. Platform administrators do not have access through the product to view or read those conversations.

Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk for other users, or where required by law.

Sections that by their nature should survive termination will continue to apply, including ownership, disclaimers, limitations of liability, and dispute provisions.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARTIAN LIST AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Indemnity

You agree to defend, indemnify, and hold harmless Martian List and its affiliates from claims, damages, losses, and expenses arising from your content, your use of the Service, or your violation of these Terms.

Changes to these Terms

We may modify these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
